1. Agreement & Acceptance

By accessing our website or engaging our services (consulting, courses, membership, etc.), you agree to these Terms. Where you make a booking, these Terms, plus any service-specific terms, govern our engagement.

2. Services Provided

Nelston offers property consultancy, training, mentoring, community membership, strategy, and investment planning services. We provide guidance, consultancy, and actionable recommendations based on experience and market research, but outcomes depend on your actions and external factors.

3. Fees, Payment & Refunds

⦁ Our fees are disclosed upfront at point of sale.

⦁ Payment must be made through the designated payment gateway before service provision (unless otherwise agreed).

⦁ Refunds (if any) will follow our refund policy, as communicated at purchase.

⦁ Late payments may incur interest or suspension of services.

4. Client Responsibilities

You must provide accurate, up-to-date information, access, and cooperation required for us to deliver services. You accept responsibility for your decisions, choices, and investment outcomes based on our advice.

5. No Guarantee of Results

Whilst we strive for excellence, we do not guarantee specific financial gains, returns, or outcomes from property investments. Property markets are subject to change. Your success depends on many variables beyond our control.

6. Limitation of Liability

To the fullest extent permitted by law:

⦁ We exclude liability for indirect, incidental, or consequential losses (e.g. lost profits, loss of business).

⦁ Our total liability arising from our services will be limited to the amount you paid for the relevant service.

⦁ Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.

7. Intellectual Property

All content, resources, training materials, branding, copy, and methodologies provided by us remain our intellectual property. You may not reproduce, distribute, or use them beyond permitted usage without written consent.

8. Termination

We reserve the right to terminate or suspend access to services or community membership for breach of terms, non-payment, or misuse of our resources. On termination, your access ends, but accrued rights (e.g. fees owed) survive.

9. Amendments

We may update these Terms occasionally. Changes will be notified via email or website notices, and continued use constitutes acceptance.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of England & Wales. Any dispute will be resolved through the courts of England & Wales (unless otherwise agreed).

CONSENT LANGUAGE

You should include clear consent statements in every form where you collect contact data or plan to send marketing communications (email, SMS, phone). Examples:

“By submitting this form, you consent to receive communications (email, SMS, calls) from Nelston Property Consultants regarding your enquiry, our services, and related offers. You may withdraw consent at any time by unsubscribing or replying STOP to SMS.”

“Tick here [ ] to receive our monthly newsletter, special offers, and property insights by email or SMS.”

Ensure that consent is freely given, specific, informed, and unambiguous. Pre-ticked boxes are not permitted under GDPR. You should keep audit logs of consent, date/time, and the form used.

Also in telephone conversations or sales calls, begin with a script:

“Before we proceed, do I have your permission to contact you by email, SMS, and phone about property-related services? You can opt out at any time.”
